Khaos Creates, Inc., a Florida Corporation doing business as Crafted Art Club (hereinafter referred to as company, studio, Crafted, site, we) reserves the right to modify or update these Terms at any time by posting on the Site or by any other reasonable means of communication. We also reserve the right, at any time, to modify or update additional company Policies in the same manner. You confirm your acceptance of the modifications or updates by continuing to use the Site. SHIPPING Shipping and processing charges are to compensate us for the cost of processing your order, packing, and delivering the products you purchase. We encourage you to also review detailed information about our shipping and processing fees. TAXES Khaos Creates Inc is not responsible for any taxes applied to your order. All fees imposed during or after shipping are the responsibility of the customer. INTELLECTUAL PROPERTY Site Materials, (including all of its information and contents such as photographs, images, text, data, wallpapers, icons, characters, artwork, graphics, page layout, form, music, sound, messages), is the property of Khaos Creates, Inc. Materials are broadly protected by applicable laws in the United States. Ceramics Membership Agreement & Policies

Effective Upon Registration & Payment. This Ceramics Studio Membership Agreement (“Agreement”) is entered into by and between Khaos Creates, Inc. dba Crafted Art Club (“Crafted,” “Studio,” “Staff,” “we,” or “us”) with its principal place of business at 4833 Coconut Creek Parkway, Coconut Creek Florida 33063 and the individual purchasing a ceramics membership (“Member,” “participant,” “Registrant,” “you,” or “your”). By registering for a membership, submitting payment, enrolling in auto-billing, or accessing the Studio, you acknowledge that you have read, understood, and agree to be bound by all terms below. If you do not agree to these terms, do not enroll or use the facilities. ELIGIBILITY, ENROLLMENT, & MEMBERSHIP ACCESS Memberships are available only to individuals eighteen (18) years or older. Crafted offers various membership types governed by individual policies. Membership is not guaranteed and registrants must interview with Staff as a condition of enrollment. Membership becomes effective only after staff approval. Registrants may be denied or dismissed during the enrollment process at the discretion of Staff, without explanation. In this case, the registrant will be notified in writing and the membership fee refunded. Members are allowed access to the ceramics studio twenty-four (24) hours a day, and seven (7) days a week. Access and membership benefits are provided on an individual basis and may not be shared, loaned, or transferred. Guests are strictly prohibited at all times. Any Member who brings a guest into the Studio (even briefly) will be: - Invoiced a $45 Day-Pass Fee per guest per incident, and - Subject to immediate membership suspension or permanent termination at Crafted’s discretion. Membership types include Create Studio Membership, Founding Membership, and Outside Membership. Create Studio Membership includes, but is not limited to: Studio access, Use of facilities and shared resources, Personal storage area, Unlimited firing of eligible pieces during the month, Discounted Rates on Classes and Workshops, Member-only Exclusive events and training. Founding Membership, offered during first two (2) months of Crafted Art Club opening, provided a discounted rate for the following: Studio access, Use of facilities and shared resources, Personal storage area, Unlimited firing of eligible pieces during the month, Discounted Rates on Classes and Workshops, Member-only Exclusive events and training. Members may maintain this discounted rate only through monthly renewal or pausing their membership. Cancellation of this membership type removes future eligibility for the discounted rate. Outside Member includes, but is not limited to: Prioritized firing of eligible pieces during the month, Access to studio glazes, Discounted Rates on Supplies, Classes & Workshops MEMBERSHIP PAYMENTS & AUTO-BILLING All memberships are billed monthly and renew automatically until canceled. Member may opt to pause their membership through the website membership portal or by written request to the studio at hello@craftedartclub.com By enrolling, you authorize Crafted to charge your card or account on file. All sales are final. Membership fees are non-refundable, including for non-use, personal schedule changes, or facility closures related to repairs or safety. Failure to update payment information or repeated failed payments may result in suspension or termination. STUDIO CONDUCT & SAFETY REQUIREMENTS Members have 24/7 unsupervised access so safety and security rules must be followed at all times: A. General Safety - Follow all posted studio rules, signage, and staff instructions. - Clean up after themselves and follow studio resource conservation practices - Do not operate equipment you are not familiar or trained on. - Never prop open locked doors or allow tailgating into the space. - Take breaks when necessary and maintain awareness of surroundings. B. Equipment Use Use all equipment, tools, and studio resources responsibly. Intentional misuse or negligent behavior that results in damage will be treated as a breach and may result in: - Suspension or termination of membership, - Repair or replacement charges invoiced to you, - Loss of future privileges. KILN & FIRING POLICIES Our studio is a mid-range firing studio, supporting clay, glazes and fireable materials that are rated for function and maturity at Orton cone temperature 06 for bisque and Orton cone temperature 6. By becoming a Member, you agree to follow all firing and clay-usage rules provided by Crafted, including (but not limited to): - Only approved clay bodies and glazes may be used (Orton Cone 06 & 6). - You must follow all labeling and shelving procedures for bisque and glaze loads. - Wet or improperly assembled pieces will not be fired, determined at the discretion of Studio staff. If your piece damages the kiln because you did not follow studio policies, you are responsible for: - Any repair or replacement costs, - Any resulting downtime or loss caused to the studio, - Possible membership termination. Crafted reserves the right to make final determinations about firing safety and procedure. PERSONAL PROPERTY Members bring all personal items at their own risk. This includes and is not limited to any and all items, machinery, and motor vehicles entering the premises as well as any personal property in and around the close proximity of Studio premises. Crafted is not responsible for: - Lost, stolen, or damaged items or property - Work left beyond the pick-up deadline - Work damaged during drying, bisque firing, glaze firing, or cooling - Unclaimed pieces may be discarded or repurposed after 4 weeks of storage. MEDIA RELEASE & STUDIO MONITORING The Studio uses 24/7 security cameras for safety and operational needs. By entering the space, you consent to being recorded. The Studio uses fingerprint technology to facilitate member access outside of business hours. The smart lock is managed by TTLock Solutions, which by business nature keeps this information encrypted, held privately, and inaccessible by Staff. Members may request, in writing, the option to use a door code in place of fingerprints. Members grant Crafted permission to use images, audio, video, or likeness captured in the studio for marketing, promotion, or internal use, without compensation, royalties, or future claim. Members may not record other members without consent. BYOB POLICY(Beer/Wine Only) Members ages twenty-one (21) years and above may bring their own beer or wine during personal studio time, in accordance with state and local regulations. Hard liquor is not permitted. Members assume all liability for consumption and must drink responsibly. Alcohol may never be provided to others (including other members). Members consuming alcohol must still follow all safety rules. Members behaving in an unsafe or hazardous manner as a result of this policy may be asked to leave the premises at the discretion of Staff. Severe or multiple occurrences of this behavior may lead to cancellation and revocation of membership. PROHIBITED CONDUCT The following are considered breaches of this Agreement: - Bringing guests into the studio - Intentional or reckless damage to equipment, tools, kilns, or workspaces - Theft of materials, equipment, or other members’ work - Unsafe handling of tools, clay, glazes, or equipment - Tampering with kilns, electrical systems, security systems, or locks - Violations of 24/7 access security (tailgating, sharing codes, propping doors) - Unprofessional, aggressive, or disruptive behavior - Unauthorized resale or teaching of classes - Any illegal activity of any kind on premises BREACH OF AGREEMENT & TERMINATION Crafted reserves the right to take any of the following actions at its sole discretion if a breach occurs: - Written warning - Suspension of membership - Permanent termination of membership - Charging fees for damages or guest violations - Denial of future enrollment No refunds will be issued in connection with termination for cause. LIABILITY WAIVER & INDEMNIFICATION By becoming a Member, you acknowledge that ceramics involves physical activity, heavy equipment, sharp tools, chemicals, and heat from kilns. You voluntarily assume all risks, including but not limited to: - Injury from tools or equipment - Burns, cuts, slips, or falls - Kiln-related hazards - Allergic reactions or chemical exposure - Damage to personal property or artwork Member agrees to conduct themselves professionally at all times, follow all safety procedures for handling tools and materials, and hold harmless Khaos Creates Inc., Crafted Art Club and all partners for any injury, accident, or damage. Member shall comply with all statutes, laws, ordinances, rules, regulations, and lawful orders of the United States of America, State of Florida, City of Coconut Creek, and of any other public authority which may be applicable to the use of Crafted’s facilities. Member shall exercise reasonable care and precaution at all times for the protection of persons and property on the premises provided under this Agreement. Safety provisions of all applicable laws and ordinances shall be strictly observed. Crafted reserves the right to expel any person from property who is causing a disturbance, is conducting themselves in violation of Crafted rules, regulations, ordinances or whose conduct or activity presents a safety risk or public nuisance. Neither Crafted nor any of its officers, agents or employees shall be liable to Member for any damages that may be sustained by Member through exercise by Crafted of such right. Member agrees to indemnify, defend, save and hold Crafted, its officers, agents, and employees, harmless from any and all claims, damages, liability, losses, causes of action of any nature whatsoever, which may arise out of, in connection with, or because of the action, inaction, behavior or negligence of Member. MODIFICATIONS Crafted reserves the right, at its sole discretion, to amend, modify, update, or replace any portion of this Membership Agreement, the Studio Rules, or any related policies at any time and without prior individual notice, except where notice is required by applicable law. Revisions will be posted on the Crafted Art Club website and will become effective immediately upon publication, unless a later effective date is expressly stated. Continued membership, continued auto-billing, or any use of the Studio after the effective date of revised terms shall constitute your full acceptance of the updated Agreement. Members understand and agree that: - It is their responsibility to regularly review the Membership Agreement and Studio Policies posted on the website. - Crafted is not obligated to notify Members individually of changes, and website publication alone is sufficient notice. - Crafted may implement new policies or discontinue existing ones to maintain safety, operational efficiency, legal compliance, or business needs. If a Member does not agree to the updated terms, their sole remedy is to discontinue use of the Studio and cancel their membership in accordance with Crafted’s cancellation policy. Any modifications shall not retroactively alter previous obligations, fees, or liabilities incurred prior to the date of the update. All changes, additions, or amendments posted on the website shall carry the same force and effect as if originally included in this Agreement. GOVERNING LAW The validity, construction and effect of this Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any claim, objection or dispute arising out of the terms of this Agreement shall first be attempted to be resolved through good faith negotiation between the parties. If not resolved, the dispute shall be submitted to binding arbitration in the Seventeenth Judicial Circuit in and for Broward County, Florida, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding. Each party shall bear its own legal costs related to arbitration. This Agreement constitutes the entire understanding between the parties. No other oral or written agreement shall be binding unless signed by both parties. Member shall not assign, delegate, transfer, or otherwise encumber any rights, obligations, facilities, or services provided by or resulting from this Agreement without the written consent of Crafted. ACCEPTANCE OF TERMS By purchasing a membership, enrolling in auto-billing, accessing the Studio, or using any facilities operated by Crafted Art Club (Khaos Creates, Inc. DBA Crafted Art Club), you acknowledge and agree that you have read, understood, and consent to be bound by the full Membership Agreement, Studio Rules, Firing Policies, Safety Policies, and all terms posted on the Crafted Art Club website. You further agree that: - Your payment constitutes your electronic signature, and is legally binding under the Florida Uniform Electronic Transaction Act (UETA). - This Agreement is entered into voluntarily between you and Khaos Creates, Inc. (the “Studio”). - You are over 18 years of age, legally able to enter into agreements, and personally responsible for compliance with all policies. - Your continued use of the space, facilities, tools, equipment, or 24/7 access constitutes ongoing acceptance of all current and future terms, including any updates as described in the Modifications clause. - You agree that you have had the opportunity to ask questions, review policies prior to payment, and seek clarification before becoming a member. If you do not agree with any portion of the Membership Agreement or future posted updates, your sole remedy is to discontinue use of the Studio and cancel your membership in accordance with the cancellation policy.

Shipping Policy

Shipping charges are to compensate us for the cost of processing your order, packaging supplies, and delivery. We ship to the United States and internationally through USPS services that offer tracking and insurance whenever possible. 

 

Shipping to the U.S.  with USPS Priority Mail® typically takes 3-5 business days and shipping internationally with First-Class Package International Service® typically takes 6-10 business days.

 

We are committed to sustainability and will always seek to use recycled and recyclable shipping items when possible. Larger items are double-boxed to avoid breakage and all packages have a fragile notice to reduce mishandling. 

 

Damaged or Broken Items
We take great care in packaging our ceramics to ensure they arrive safely. However, if your order arrives damaged due to carrier mishandling, please contact us within 48 hours of delivery. To assist with a claim, provide clear photos of the damaged item, the packaging, and the shipping label. We will work with you to file an insurance claim with USPS.

 

Because each piece is handmade and often one of a kind, we do not offer replacements or refunds. If a claim is approved, we may issue store credit toward a future purchase. Please note that all claims must be submitted promptly, as shipping carriers have strict timeframes for damage claims.

Refunds, Returns & Transfers Policy

Crafted Art Club provides hands-on creative experiences and offers handmade goods in our gift shop and local artist marketplace. Because our workshops and products are unique, one-of-a-kind, and created in small batches, the policies below help protect the integrity of our programming and the artists who make our work possible.

 

CLASS, WORKSHOP & EVENT REFUNDS

Registration is confirmed once full payment is received through our website, ticketing platform, or in-studio enrollment. All event, class, and workshop sales are final. Crafted Art Club may, at its sole discretion, approve credits or transfers according to the event’s posted terms, but refunds are not guaranteed.

 

Guests arriving more than 15 minutes late may forfeit their seat without a refund or credit. Guests removed for misconduct, intoxication, unsafe behavior, or violation of studio policies are not eligible for any refund or credit.

 

CREDITS & TRANSFERS

If Crafted Art Club grants a credit or transfer, it is considered a one-time courtesy. Credits or transfers must be rescheduled and used within 30 days of the original event date. Unused credits expire after that window and hold no value. Credits cannot be converted into refunds, transferred to another person, or extended beyond the 30-day limit.

 

RETURNS & EXCHANGES FOR GIFT SHOP / LOCAL ARTIST MARKETPLACE

All gift shop and artist marketplace items are handmade and may contain natural variations. All sales are final. Returns may be considered only in rare cases of damage that occurred prior to pickup and solely at the discretion of Crafted Art Club or the selling artist.

 

We do not offer replacements or exchanges for handmade items, including custom pieces, discounted items, “seconds,” or “happy accidents.” If you believe an item was damaged before pickup, contact care@craftedartclub.com within 48 hours and provide photos. Any approved returns will receive store credit only. Returned items must arrive in their original condition.

NO WARRANTY ON CERAMICS

Due to the unpredictable nature of ceramics and kiln firing, Crafted Art Club does not guarantee that any pottery piece will survive the firing process. We do not offer refunds, credits, replacements, or discounts for broken, cracked, exploded, or lost pieces.

When you conduct a transaction on our website, as part of the process, we collect information you give us such as your name, address and email address. Your information will be used for the specific reasons stated only: - To provide and operate our Services; - To provide our Users with ongoing customer assistance and technical support; - To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages; - To comply with any applicable laws and regulations. Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you. Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.
